In this Policy, “personal information” means any information that identifies, relates to, describes, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly to an individual, household or device. For purposes of this Policy, personal information does not include: (i) publicly available information from government records; (ii) deidentified, aggregated or anonymized information that is maintained in a form that is not capable of being associated with or linked to you; and (iii) information relating to our employees or contractors, which is covered by a separate policy.

PERSONAL INFORMATION WE COLLECT
When you visit our Site or interact with one of our representatives we may collect certain pieces of personal information about you, such as:
Contact Information: we collect your first and last name, date of birth, business mailing address, business email address, company name, and phone number.
Other identifying information: we collect IP address, campaign identifiers, social media usernames and profiles, online and advertising identifiers, passwords, and other security information for access.
Product Information: we collect information on how you use our products and services offerings from us or what you have viewed on the Site, such as event information, budgets and more.
Financial Information: through our processors and on behalf of our clients, we collect encrypted credit card, debit card and bank account information.
Employment Information: we collect employment and education information when you apply for a job with us.
Internet or other electronic activity: we collect your browsing and click history, your scrolling activities, your IP address and device identifiers, browser type, operating system and type, online identifiers, keystrokes, mobile identifiers information, read receipts, metadata, time zone and other online activity information including that which shows how you navigate our website, what other sites you came from, conversion history, purchase history, booking information, travel posts and photos, guest booking preferences, and which elements of our services you use the most.
Advertising and Marketing Information: such as how you interacted with advertisements on our sites and third party sites, such as social media platforms how many times you viewed an advertisement, your account profile or social media identifier, posts or related data, audience interest segments, marketing analytics data, offline customer data, and information to measure the effectiveness of campaigns.
Customer Service Information: when you interact with our chat bot on the Site, submit a request for information or interact with a Tambourine representative, we collect your contact information, email, phone number and company name.
SOURCES OF PERSONAL INFORMATION
The categories of personal information described above may be collected from the following sources:
Directly. We collect personal information from you directly when you:
- Submit a request for information using the form on our Site;
- When you apply for a job on our Site;
- Purchase products or services through our Site or through one of our representatives;
- Engage with the Site’s live chat; and
- Interact or otherwise communicate with one of our representatives.
Automatically. We collect personal information from you automatically when you:
- Visit, browse and navigate our Site on any device;
- Click on sponsored links or third-party advertisements; and
- We may also collect personal information or inferences about you when you use our Site, using tracking technologies such as chat bots, cookies, pixels, and web beacons and we may use third party services to collect this personal information when you use our Site. For example, we use targeted advertising to see if you have interacted with or advertising on other sites,. The information we obtain in this manner allows us to customize the services we offer to our customers and our site to deliver targeted advertising.

From our Affiliates. We may receive personal information about you from our affiliates.
From Third Parties. We may also receive information about you from other third-party service providers, such as marketing and advertising advertisement platforms and networks, analytics companies, social media companies and others. In many cases, this will be information that you have provided directly to or collected from you by these third-parties. We make inferences from your online behaviors from combining that data with other third party segmentation and advertising profiles, including your travel behaviors; and we supplement your personal information with third party information to provide you better products, services and marketing.
By Combining Personal Information. We may combine personal information that we collect online and offline, from different devices that you use, or information we obtain through third parties with personal information we already have about you.
HOW WE USE THE PERSONAL INFORMATION WE COLLECT
We may use personal information we collect for the following purposes:
Transactional Purposes. To fulfill or meet the reason you provided the information. To process your requests, purchases, transactions and payments. To provide you with customer support and to respond to your inquiries, to investigate and address your concerns and monitor and improve our responses; and process any registration you make to one of our Services.
Job Applications. To review and analyze your job application.
Personalization. To provide, support, personalize and develop the Site, and our services.
Analytics and Performance. For testing, attribution, research, reporting, analysis, and product development, including to develop and improve our marketing and advertising programs, the Site, products, and services.
Communications. Communicating with you to fulfill or meet the reason you provided the information, for example, if you share your name and contact information to request information via the Site or ask a question about our products or services, we will use that personal information to respond to your inquiry. If you provide your personal information to purchase a product or service, we will use that information to process your payment and deliver the product/service. We may also save your information to facilitate new orders or renewals for our services/products.
Security and Fraud Purposes. We may use your personal information to protect our Site and customers from fraud, identity, theft and security incidents.
Legal Purposes: In certain instances we may use and/or disclose your contact information when we have reason to believe that it is necessary to identify, contact or bring legal action against persons or entities who may be causing injury to you, to us, or to others. We may also disclose your contact information when we believe the law or legal process requires it or as required by governmental or judicial subpoena.
Internal Business Purposes: We may use your personal information to improve and operate our business, such as tracking our revenue or conversion history.
Marketing & Advertising Purposes: If you have filled out a contact form with us, signed up for Our Newsletter we may use this information to send you marketing communications including other newsletters and emails. We may also use this information to send you marketing communications for our clients as applicable. You can opt out of receiving these communications at any time by clicking the “opt out” link at the bottom of these emails or by emailing us directly at privacy@tambourine.com.
We may also use your contact information, information we collect automatically, and certain information about your device, including information about your web browser, IP address, online identifiers, CTV identifiers, time zone, and through cookies and other digital trackers for other marketing related purposes as explained below.
If you access our Site from a social media platform (e.g., Instagram and TikTok) we may receive information about you from such sites, in accordance with that social media platform’s privacy policy and/or terms of use which could include the ability for us to track your activities on those sites, such as your interactions with our advertisements as well as other interest based advertising data.
Additionally, as you browse the Site, we collect information about the individual web pages that you view, what websites or search terms which referred you to the Site, and information about how you interact with the Site.
WHO WE DISCLOSE, SHARE AND SELL THE PERSONAL INFORMATION TO
Our Affiliates. We may disclose your personal information to our Tambourine family of companies. This will include our offices in Mexico and Columbia.
Our Service Providers. We disclose your personal information to third parties that provide business, professional, marketing, analytic, or technical support services for us and/or administer activities on our behalf. We make these business purpose disclosures under written contracts that describe the purposes, require the recipient to keep the personal information confidential, and prohibit using the disclosed information for any purpose except performing the contract.
Our Business Partners. We disclose, share and sell your personal information to our business partners in order to provide you with the products and services you have requested or for marketing purposes. These third parties may use this information for their marketing, development and analytics purposes. We use certain chatbots that may use your personal information to improve their artificial intelligence solutions.
Relevant Third Parties in Connection with a Business Transaction. We may disclose or otherwise transfer your personal information to an acquirer, successor, or assignee as part of any merger, acquisition, debt financing, sale of assets, or similar transaction as well as in the event of any insolvency, bankruptcy, or receivership in which information is transferred to one or more third parties as one of our business assets.
Law Enforcement. Finally, we may also disclose your Personal Information to comply with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.
HOW WE USE COOKIES AND DIGITAL TRACKING TECHNOLOGIES.
We engage in interest-based advertising to deliver online advertising that may be more relevant to your interests.
We use “cookies” or other digital trackers that are placed on your device or computer and often include an anonymous unique identifier. Through the use of a cookie, we also may automatically collect information about your online activity on our site, such as the web pages you visit, the links you click, and the searches you conduct on our site. This means that we permit third party online advertising networks, social media companies, and other third party services to collect information about your use of our Site over time so that they may advertise to you on other websites or services you may use, and on other devices you may use. Most often, the information used for interest-based advertising is collected through cookies, pixels, beacons or similar digital tracking technologies. We may share a common account identifier or hashed data with our third party advertising partners to help identify you across devices or serve you ads on social media or advertising sites you may use. We and our third party partners use this information to make the advertisements you see online more relevant to your interests, as well as to provide advertising-related services such as reporting, attribution, analytics, and conversions.
We may infer these things about you based on your activity on certain webpages, including your scrolling activity, keystrokes and browning, links you click on our Site and other websites you visit, mobile applications you use, or our brand emails you view and links you click in the emails, and based on other information we have collected, such as from travel sites and other third parties. We group together information to help us learn about general trends, habits or characteristics about a group of customers who act similarly online or offline and use this information to provide you a better experience online.
Google Analytics and Advertising:
We use Google Analytics to better understand how our users interact with our Site. Our ability to use and share information collected by Google Analytics about your visits to our sites is restricted by the Google. Google Analytics through your web browser automatically sends back certain information to Google. This could include the URL of the page you’re visiting and your IP address. Google then may use the IP address, for example, to identify your general location, to measure the effectiveness of ads, and, depending on your settings, to improve the relevance of the ads you see.

Opting Out of Marketing Communications. If you opt out, we may still send you non-promotional messages, such as about products and services that you have purchased.
Declining Cookies and Pixels. You are always free to decline any cookies and pixels we use by adjusting the settings of your browser or on the cookie tool on our website. INFORMATION SECURITY
We maintain reasonable administrative, technical and physical safeguards designed to protect your personal information from unauthorized access, destruction and disclosure. However, no system can be completely secure in today’s environment. We cannot guarantee your information, searches, or other communications will always remain secure. The safety and security of your personal information also depends on you taking care in your online practices.
PERSONAL INFORMATION RETENTION
We will retain your personal information as long as necessary to fulfill the purposes outlined in this Policy, including to satisfy our legal or reporting requirements, unless a longer retention period is required or allowed under law. We reserve the right to provide access to or delete personal information only to the extent required by applicable law. We will limit any personal information collected and used to the purposes of the processing.
THIRD-PARTY SERVICES
The Site may contain features or links to websites and services provided by third parties, which are not governed by this Policy. Any personal information you provide to the owner or operator of another website or a third-party service is provided directly to the owner or operator and is subject to its privacy policy, even if accessed through the Site. We encourage you to review all third parties’ privacy policies before providing them with your personal information.
CHILDREN’S PRIVACY
The Website and the products and services offered there are not intended for or directed to individuals under the age of 18, and we do not knowingly collect personal information from individuals under the age of 18. Upon receipt of your request, we will endeavor to honor it based on the information that we collect and maintain. Depending on the nature of your request, you will need to do the following in order for us to honor it:
- Provide minimum information that allows us to reasonably verify you are the person about whom we have collected personal information. As required under applicable laws, we will use the requested information for verification purposes only.
- Describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.
We may use third parties to verify your identity and process your request. We will evaluate your request, as required by applicable law, and respond to your request within 45 days, if we are able to verify your identity. Please note that we may decline certain requests if we cannot verify your identity and confirm the personal information we maintain relates to you.
If you have any questions about your rights or the form, please email us at privacy@tambourine.com. Please note that you may only make a request to know/access or data portability twice within a 12-month period.
Authorized Agents. You may authorize someone to submit a privacy rights request on your behalf (an “authorized agent”) using the submission methods outlined above. An authorized agent will need to demonstrate that you have authorized them to act on your behalf, unless you have provided the agent with power of attorney pursuant to applicable probate law. Depending on the evidence provided, we may also contact you to verify your identity directly with us or request confirmation from you that the agent is authorized to submit the request on your behalf.
Appealing Privacy Rights Decisions. Under applicable laws, you have the right to appeal a decision we have made in connection with your privacy rights request. All appeals should be submitted via email to privacy@tambourine.com with the word “APPEAL” clearly indicated in the subject line. If you are unsatisfied with the way that we have handled your appeal, you may have the right to complain.
Other California Privacy Rights. The California Civil Code permits California Residents with whom we have an established business relationship to request that we provide you with a list of certain categories of personal information that we have disclosed to third-parties for their direct marketing purposes during the preceding calendar year. RESERVHOTEL INC. PRIVACY NOTICE
This additional notice explains how your personal information is handled when you use our hotel booking engine, operated by our subsidiary ReservHotel LLC (“ReservHotel”). Please note that ReservHotel acts solely as a data processor on behalf of a hotel or travel provider (the “Data Controller”). This means ReservHotel processes your personal information only as instructed by the Data Controller and does not use your personal information for its own purposes.
What Data Is Processed and for What Purpose. When you make a booking or inquiry through the Reserv Hotel engine, ReservHotel processes personal information such as name, contact details, booking information (such as date, room preferences and stay duration), and any other information you provide as part of your booking. This information is used solely in aggregate form for the following purposes: (i) Reserv Hotel booking engine products and services; (ii) analytics to improve such products and services; (iii) fraud prevention, security purposes and aggregated analytics; and (iv) to respond to governmental and judicial subpoenas. Individual identities are not included in any reports or analyses.
Sharing of Data. ReservHotel acts as a data processor for our customers and shares personal information in accordance with these data processing agreements.
Your Rights. Your hotel or travel provider, our customer is responsible for your personal information, any data subject access requests to as it relates to the ReservHotel booking engine should be directed to the hotel or travel provider with whom you made your booking. We will assist our customer in responding to such requests as required under our agreements with them.

OUR OTHER DATA PROCESSING ACTIVITIES
Processing Activities. For many of our clients, we act as a data processor on behalf of our clients, hotel companies, who are the data controller. This means we process your personal information only as instructed by the data controller pursuant to our agreements with them and do not use your personal information for our own purposes.
Your Rights. Our customer is responsible for your personal information, any data subject access requests to as it relates to their data activities should be directed to the hotel. We will assist our customer in responding to such requests as required under our agreements with them.

INTERNATIONAL DATA TRANSFERS
EU-US DATA PRIVACY FRAMEWORK, UK EXTENSION OF THE EU-US DATA PRIVACY FRAMEWORK AND SWISS DATA PRIVACY FRAMEWORK COMPLIANCE
Tambourine, ReservHotel and its subsidiaries, comply with the EU-US Data Privacy Framework (“EU-U.S. DPF”) and the UK Extension to the EU-U.S. DPF, and the Swiss-U.S. Data Privacy Framework (“Swiss-U.S. DPF”) (collectively, the “DPF”) as set forth by the U.S. Department of Commerce. Tambourine has certified to the U.S. Department of Commerce that it adheres to the EU-U.S. Data Privacy Framework Principles (“EU-U.S. DPF Principles”) with regard to the processing of personal data received from the European Union and from the United Kingdom in reliance on the EU-U.S. and the UK Extension to the EU-U.S. DPF. Tambourine has certified to the U.S. Department of Commerce that it adheres to the Swiss U.S. DPF Principles (“Swiss U.S. DPF Principles”) with regard to the processing of personal data received from Switzerland in reliance on the Swiss-U.S. DPF. If there is any conflict between the terms in this privacy policy and the EU-U.S. DPF Principles and/or the Swiss-U.S. DPF Principles, the DPF shall govern. To the extent that we disclose personal information to third parties, the types of third parties and the purposes for such disclosure are stated in this Policy and summarized in the sections titled Who We Disclose, Share and Sell Personal Information To.
Complaints
In compliance with the EU-U.S. DPF, the UK Extension of the EU-U.S. DPF, and the Swiss U.S. DPF, Tambourine commits to resolve complaints about your privacy and Company’s collection or use of your personal information transferred to the United States pursuant to the DPF Principles. European Union, United Kingdom, or Swiss individuals with inquires or complaints regarding this privacy policy you should first contact the Company by sending an Email at privacy@tambourine.com.
Tambourine has further committed to refer unresolved privacy complaints under the DPF Principles to an independent dispute resolution mechanism, JAMS, an alternative dispute resolution provider located in the United States. If you do not receive timely acknowledgement of your DPF Principles related complaint from us, or if Company has not addressed your DPF Principles-related complaint to your satisfaction, please visit https://www.jamsadr.com/DPF-Dispute-Resolution for more information or to file a complaint. The services of JAMS are provided at no cost to you.

Disclosures for national security and law enforcement
Please note that under certain circumstances we may be required to disclose your personal information in response to lawful requests made by public authorities, including to meet national security or law enforcement requirements.
Onward Transfers to Third Parties.
In the event that the Tambourine discloses your personal information to third-parties Tambourine is accountable for personal information that it subsequently transfers to a third party is described in the DPF Principles and contractually will bind such third parties to DPF Principles. Tambourine has subsidiaries in Colombia and Mexico.
